What Counts as Domestic Violence in South Carolina?

Domestic violence in SC means harming or threatening to harm someone you live with, used to live with, are married to, or share a child with.

There are three levels:

1st Degree: Serious injury, use of a weapon, violation of a restraining order, or in front of a child. Up to 10 years in prison.

2nd Degree: Moderate injury, choking, weapon use, or a prior DV charge. Up to 3 years in prison.

3rd Degree: Lesser injuries or threats. Up to 90 days in jail.

A conviction can also mean losing your right to own a gun—even on a first offense.
